Question : Is a phone interview legal if all other prospects got in person interviews?
Hello,
I live in California and recently my store manager transferred. I have been with the company three years and am the assist manager. I applied for the position. The district manager did a short phone interview, and then did some face to face interviews with everyone but me. Afterward she hired someone from outside the company. Is this legal? I do not feel I got a fair interview? I have have an outstanding record of service with the company and further more I have 8 years of management experience.
Is there anything I can do?

No. A phone interview is the first step. Only applicants that are great potentials are called in for a face to face. You phone interview apparently did not impress anyone. Start looking else where. They will now expect you to train the outsider.

Yes, perfectly legal.
They gave you the opportunity to apply and interview for the job.
That is all they have to do to be fair.It is still up to them to choose who gets the job. It’s a free market.
So if they had an applicant that was better qualified for the job then they are by all means allowed to choose that applicant over you. -

Sorry, they did not feel you were the right candidate. We used to post the information on the employee bulletin board about in house positions. Most of the time we had someone in mind already for the position but to be fair we had to post for our employees. We did the interviews but usually hire outside.
Since you have over 8 years in Management, I would start looking for another job; however maybe this person they hired does not work out and you may get another shot to prove yourself.
