Question : HELP!! How do I fire my real estate agent?
In very early July I signed on with a realtor, though initially I was FSBO. He promised he would do all this marketing and hoohah and as FSBO I was showing the house once or twice a week. Since he took over, he hasn’t shown the house once. Not a single time. I was still getting leads so out of courtesy I sent them on to him. Still no showings. So I gave up and just showed the house myself.
I’m beyond mad that if I sell this house he gets 6% for not doing a damn thing except tell me “Well no showings this week, you shuld drop the price.”
Now here’s the funny part – I’m going to his broker today to file a formal complaint. But I was going over my contract – and according to the typed up contract I signed with him – the contract expired January 31st, 2008. Instead of 2009. Now it’s obviously a mistake but is it a big enough loophole to get me out of my contract with this monstrosity of a waste of oxygen?
See and that’s the thing – he hasn’t shown the house to ANYONE! Not ONE single person! I know I sure as hell have.

You are probably wasting your time …. since also in the contract; it will say it is a six month or 180 day listing ….
I have said from the very beginning that it is the REALTORS causing this market slump by trying to make everyone LOWER the prices on their homes so THEY can get a Commission ……
I’m very lucky to have a realtor who understands that I KNOW the value of my home …. and has not suggested that I lower it a dime …
However; the market is SLOW but beginning to pick back up ….. Next time you list ..IF you do , make sure they will let you out of the contract if you are disatissfied …. Make sure that is in writing .
NOTE: You still might be able to get out of your contract ..just go to the broker and Complain ..tell them you are NOT satisfied with their services and would like to be released from the contract ..Most likely; they will …

YES you can terminate listing
Tell broker and realtor that you want contract voided, that it has erroneous date, that you are unhappy with performanceNEVER sign a listing agreement for such a long time; 90 days is long enough, though of course in this market, they want as long a contract as possible. I prefer 30-60, but in this market. . . . Most brokers/realtors will let sellers out of listing agreement when they are unhappy–as long as you don’t turn around in less than a month and sell to some one they showed place to.
Put termination in writing, have them do it

well, if the typed and signed contract says the expiration date is 2008, then it’s 2008, it should have been double checked by an attorney or whoever wrote it up, maybe him, before it was signed so you have every right to get out of the contract, especially if he’s not holding up to his end of it. I can’t believe he hasnt shown it to a single person-does he not want to make money or something? he sounds like a complete idiot. you need to just be honest with him and tell him how you feel and that you no longer are in need of his services.

First of all, I would like to apologize for your experience. I am a REALTOR as well and I hate hearing stories like this. As with any other professions, we do have a few that give us a bad name.
Your choices on this matter depends on the exact wording of the contract, I would advise having a real estate attorney review it before assuming anything. If you do find yourself still having to honor the contract, speak with the Broker-In-Charge of the office and let him know you are unhappy. Most of the time issues can get settled here. If this is no help, there is always the local board of REALTORs and the State Real Estate Commission. The real estate commission is there to protect the public in these types of dealings, so believe me when I say you will get an answer if you complain.
Not all REALTORs are just looking to collect a commission by lowering values. Just a shame it’s the bad ones that get the publicity.
